Fosterly Terms of Use

Effective date: September 19, 2026

These terms are an agreement between you and Austin Christian University ("Fosterly", "we", "us"). By creating an account or using Fosterly, you agree to them. Our Privacy Policy explains how we handle your information.

1. Who can use Fosterly

• You must be 16 or older.
• You must give your real date of birth.
• In some states, including Texas, the law requires a parent or guardian to approve app downloads for users under 18. Apple handles that approval.
• An account is for one person. Keep your sign-in private, and tell us if you think someone else has gotten into your account.

2. What Fosterly is, and what it isn't

Fosterly helps you make a plan, keep your documents in one place, and get help with next steps.

Fosterly is not:

• An emergency service. If you are in danger, call 911. In a mental health crisis, call or text 988.
• A government agency. Fosterly is not part of the Texas Department of Family and Protective Services (DFPS), the courts or any benefits program. Using Fosterly doesn't replace talking to your caseworker.
• Medical, legal, financial or benefits advice. Check with a doctor about health decisions. Check with your caseworker, a lawyer or the program itself about eligibility and legal questions.
• A guarantee. We can't promise that a program, shelter, school or employer will reply, have space or say yes.

3. The Fosterly agent

• It uses AI, and AI can be wrong. It can make mistakes, misunderstand you, or find information that is out of date. Read everything before you approve it.
• Fosterly suggests, and you decide. Nothing is sent in your name until you tap to approve it. That includes an email, a text, a call, a calendar event, or sharing with your circle.
• Emails. When you approve an email, one of three things happens. Fosterly sends it for you from an address that belongs to Fosterly, with replies going to you and a copy to you. Or it opens your phone's mail app with the message ready, so it goes from your own address. Or, if there is no email account on your phone, it gives you the message to copy and send from anywhere, and asks you to tell it whether you sent it. The screen says which before you tap, and Fosterly never says an email was sent unless it was. You're responsible for the messages you approve.
• Texts and calls. These open in your phone's Messages or Phone app and go out from your own number.
• AI is your choice. You can turn it off in Settings and keep using your plan, file and circle.
• Limits. We may limit how many requests or emails you can send in a period of time, to keep Fosterly working for everyone.

4. Resources and links

Fosterly's resource directory lists real organizations. We check them, but hours, rules and phone numbers change, so call ahead when you can. Being listed doesn't mean an organization works with Fosterly, or that we endorse it. Other websites have their own terms and privacy policies.

5. Your content

• Your story, plan, documents and messages belong to you.
• You give us permission to store, process and send your content only as needed to run Fosterly for you. That includes sending it to the services described in our Privacy Policy. This permission ends when you delete the content or your account, except for the copies described in the Privacy Policy, such as backups and emails you already sent.
• Only add documents that belong to you, or that you have the right to use.

6. Your circle

• Only invite people you want to share with, using their real contact details.
• The people you invite see only what you choose. You can revoke their access at any time.
• We can't control anything someone saved while they had access.

7. Using Fosterly the right way

Please don't:

• use Fosterly to harass, threaten or trick anyone, or pretend to be someone else
• use the agent to send spam or messages that have nothing to do with your own needs
• upload someone else's documents without their permission, or anything illegal
• try to get into other people's accounts or information, or to break, overload or copy the service
• run Fosterly for another person. Each person needs their own account.

8. Free, with no ads

Fosterly is free to use. There are no ads and no in-app purchases. If that ever changes, we'll tell you before it does.

9. Ending your account

• You can delete your account at any time. Tap your picture on the Today tab to open Settings, then tap Delete account.
• We may suspend or close an account that breaks these terms or puts other people at risk. When it's safe to do so, we'll tell you why and give you a chance to save copies of your documents.

10. Changes to Fosterly and these terms

We may update Fosterly and these terms. If we make an important change, we'll tell you in the app before it takes effect. If you keep using Fosterly after that, you accept the new terms. If you don't agree, you can delete your account.

11. Disclaimers and limits

Fosterly is provided "as is." To the fullest extent the law allows, we don't make promises about the service beyond the ones in these terms. We aren't responsible for indirect losses, or for decisions made by the programs, agencies or people you contact. Nothing in these terms limits any rights you have under law that can't be limited.

12. Law and disputes

• These terms are governed by the laws of the State of Texas.
• If something goes wrong, please contact us first so we can try to fix it.
• Any dispute will be handled in the state or federal courts in Williamson County, Texas, unless the law says otherwise.

13. If you got Fosterly from the App Store

• These terms are between you and us, not Apple. Apple is not responsible for Fosterly or its content.
• Apple has no obligation to provide maintenance or support for Fosterly. We do.
• We, not Apple, are responsible for handling any claims about Fosterly. That includes product claims, legal or regulatory compliance, consumer protection, privacy and intellectual property claims.
• If Fosterly fails to meet a warranty that applies, you can tell Apple, and Apple will refund what you paid for it. Fosterly is free, so that is nothing. Apple has no other warranty obligation for Fosterly.
• You confirm that you are not in a country under a U.S. government embargo, and that you are not on a U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them.
• Your use of Fosterly must also follow the App Store's Usage Rules.
